General Terms and Conditions of Sale

These General Terms and Conditions of Sale (GTC) exclusively govern the commercial relationship between Clara Jacquet, sole proprietor (hereinafter "the Seller") and any person making a purchase on the website (hereinafter "the Customer").

Article 1. Purpose and acceptance of the GTC

These GTC aim to define the rights and obligations of the parties in the context of the online sale of products offered by the Seller. Any order placed on the site implies the full and unreserved acceptance of these GTC by the Customer.

Article 2. Products and Stock

The products offered are artisanal textile creations, handmade.

  • Limited stock: Many pieces are made from carefully selected materials. Products are available while stocks last.
  • Visuals: As each piece is unique and produced in very small batches, slight variations may exist compared to the photographs on the site, without this affecting the quality of the product.

Article 3. Pricing and Payment

  • Pricing: Prices are indicated in euros (€). As a sole proprietor benefiting from the VAT exemption (Art. 293 B of the CGI), no VAT is applicable. Delivery costs are charged in addition and indicated before the final validation of the order.
  • Customs: For deliveries outside metropolitan France or the European Union, any customs duties or local taxes remain the exclusive responsibility of the Customer.
  • Payment: Payment is due immediately upon ordering. Payment is made by credit card or any other secure payment method offered on the site via the Shopify platform.

Article 4. Order and Contact Information Requirement

The Customer undertakes to provide accurate information when placing their order. Entering a valid phone number is mandatory during the payment process to ensure the proper delivery of the package. The Seller cannot be held responsible for the inability to deliver a package due to an error in the contact details provided by the Customer.

Article 5. Production and Delivery Times

Since each piece is crafted with care:

  • Preparation time: The usual processing and shipping time is 3 to 5 business days. For pieces requiring adjustments or custom personalization, this period may be extended.
  • Delivery: Carrier delivery times are provided for information purposes only. The Seller cannot be held responsible for delays attributable to transport services or cases of force majeure.

Article 6. Right of Withdrawal and Returns

  • General right (14 days): In accordance with Article L.221-18 of the Consumer Code, the Customer has a period of 14 calendar days from receipt of their package to exercise their right of withdrawal.
  • Exception for custom/personalized items: In accordance with Article L.221-28 of the Consumer Code, the right of withdrawal does not apply to products made according to the consumer's specifications or clearly personalized. These orders are considered final sales.
  • Return costs: Shipping costs related to returns are the sole responsibility of the Customer.
  • Condition of the product: Any returned product must be in perfect condition (unworn, unwashed, no perfume odor, with original tags and packaging). Failing this, no refund can be issued.

Article 7. Refunds

In the event of a return compliant with the conditions of Article 6, the Seller undertakes to refund the Customer for the price of the product within a maximum of 14 days from receipt and validation of the return. The refund is made via the original payment method. Initial delivery costs are not refunded. No exchange is offered.

Return process:

  1. Send an email to klabycla@gmail.com indicating your order number and the item you wish to return.
  2. Prepare your package with care, ensuring you include all items received (tags, original packaging).
  3. Purchase and print your shipping label from the carrier of your choice (Colissimo, Mondial Relay). Return costs are your sole responsibility.

⚠️ We strongly recommend choosing a shipping method with a tracking number. The Seller cannot be held responsible in the event of the package being lost by the carrier.

Article 8. Legal Guarantees

The products sold are covered by the legal guarantee of conformity (Articles L. 217-4 et seq. of the Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the Civil Code), allowing the Customer to return delivered products that are defective or non-compliant.

Article 9. Applicable Law and Disputes

These GTC are subject to French law. In the event of a dispute, an amicable solution will be sought as a priority. In the absence of an agreement, French courts will have sole jurisdiction.
